On November 13, 2018, the official website of the Chinese government announced the "Notice of the Central Committee of the Communist Party of China and the State Council on the Adjustment of the Duties and Organizational Establishments of the Ministry of Housing and Urban-Rural Development", marking the final determination of the transfer of the responsibility for the fire safety review of construction projects to the Ministry of Housing and Urban-Rural Development.

Notice of the General Office of the Communist Party of China Central Committee and the General Office of the State Council on Adjusting the Organizational Structure of the Ministry of Housing and Urban Rural Development (September 13, 2018)



In accordance with the Plan for Deepening the Reform of Party and State Organs deliberated and adopted at the Third Plenary Session of the 19th CPC Central Committee and the Plan for the Reform of State Council Organs approved at the first session of the 13th National People's Congress, and after being reported to the CPC Central Committee and the State Council for approval, the following notice is issued on the adjustment of the responsibilities, institutions and staffing of the Ministry of Housing and Urban Rural Development.

1、 The responsibilities of urban and rural planning management of the Ministry of Housing and Urban Rural Development will be transferred to the Ministry of Natural Resources, and the Urban and Rural Planning Department will no longer be retained. Correspondingly, 20 administrative positions and 4 bureau level leadership positions (including 1 chief planner) will be reduced.

2、 The management responsibilities of scenic spots and natural heritage under the Ministry of Housing and Urban Rural Development will be transferred to the State Forestry and Grassland Administration, with a corresponding reduction of 2 administrative positions.

3、 The responsibility of guiding the review of fire protection design for construction projects under the guidance of the Ministry of Public Security will be transferred to the Ministry of Housing and Urban Rural Development. The transfer of personnel related to the fire brigade will be determined and adjusted after transfer. The Ministry of Housing and Urban Rural Development has 15 internal institutions, 399 administrative positions, and 57 leadership positions at the department level. The establishment, responsibilities, and staffing matters of affiliated institutions shall be separately stipulated.


On November 8, 2018, the General Office of the State Council issued a notice entitled "Notice of the General Office of the State Council on Focusing on Enterprise Concerns and Further Promoting the Implementation of Policies to Optimize the Business Environment"

The Notice clearly proposes to further simplify the approval process for enterprise investment


The Development and Reform Commission will take the lead in optimizing the approval process for investment projects, and by the end of 2018, the unified names and application materials for investment market approval matters will be announced. In 2019, various types of investment approvals will be processed online in parallel; In 2019, a document was issued to guide local governments in carrying out the reform of the investment project commitment system, achieving government set standards, enterprise commitment, strong process supervision, and punishment for dishonesty, significantly reducing the landing time of investment projects.


The Ministry of Housing and Urban Rural Development should take the lead in promoting the reform of the approval system for construction projects, and work with relevant departments such as the Development and Reform Commission, the Ministry of Human Resources and Social Security, and the Ministry of Emergency Response to complete the revision of departmental regulations, normative documents, and standards such as the "Management Measures for the Review of Construction Drawing Design Documents for Housing and Municipal Infrastructure Projects", "Regulations on the Supervision and Management of Fire Protection in Construction Projects", and "Opinions on Further Improving Work Injury Insurance in the Construction Industry" by the end of 2018. Simplify and cancel some pre-approval conditions, promote the inclusion of fire protection design review, civil defense design review, etc. in the joint review of construction drawings, and further reduce the approval time limit for construction projects; At the same time, a batch of suggestions for optimizing and streamlining the approval of relevant laws, regulations, and policy documents for engineering construction projects have been put forward. In 2019, a full process and full coverage reform of the engineering construction project approval system will be carried out nationwide, guiding local authorities to unify the approval process. Through measures such as streamlining approval items and conditions, delegating approval authority, merging approval items, adjusting approval timing, transforming management methods, and promoting the notification and commitment system, the approval system will be improved, and efforts will be made to achieve "one blueprint" to coordinate project implementation, "one system" to implement unified management, "one window" to provide comprehensive services, "one form" to integrate application materials, and "one mechanism" to standardize approval operation.


In places where conditions permit, a new "standard land" system for industrial land approval can be explored and implemented. Land using enterprises can directly start construction without the need for various approvals. After completion and operation, relevant departments will inspect and accept according to established standards and legal conditions.

In May 2018, the State Council issued the "Notice of the General Office of the State Council on Launching the Pilot Reform of the Approval System for Engineering Construction Projects" (State Council Document [2018] No. 33), which clearly requires that the approval time be reduced by more than half, from the current average of over 200 working days to 120 working days.   • Cancel the registration of construction contracts, review and filing of building energy-saving design, and other related matters. The construction unit of social investment housing projects can independently decide the contracting method.

  • Incorporate technical reviews such as fire protection design review and civil defense design review into the review of construction drawing design documents, and relevant departments will no longer conduct technical reviews. Content List Style

  • Merge the engineering quality and safety supervision procedures with the construction permit for processing.   • When issuing the construction project planning permit, the design scheme review shall be conducted together, and the issuing department shall solicit opinions from relevant departments and units.   • Regional assessments shall be conducted for earthquake safety assessment, geological hazard risk assessment, environmental impact assessment, energy conservation assessment, and other related matters.

  • Implement the requirements for canceling the delegation of administrative approval matters. Evaluation matters such as environmental impact assessment, energy conservation assessment, and earthquake safety assessment are not considered as project approval or approval conditions. The earthquake safety assessment can be completed before the engineering design, and other evaluation matters can be completed before the construction permit.

  • The pre-approval opinion on land use can be used as proof of land use to apply for a construction project planning permit, and the land approval procedures can be completed before the construction permit.

  • Apply for the installation of municipal public infrastructure such as water supply, power supply, gas, heat, drainage, and communication in advance after the issuance of the construction permit. Complete the construction of relevant facilities during the construction phase, and directly handle the access matters after completion acceptance.

  • For approval matters that can be corrected through in-process and post event supervision and will not have serious consequences, a notification commitment system shall be implemented.
